Court rejects UC Rusal’s writ of appeal against AGM-2010 results

MMC Norilsk Nickel (the Company) informs that the Federal Arbitration Court of the East-Siberian district on 23.08.2011 rejected the writ of appeal by UC Rusal Investment Management LLC (subsidiary of UC Rusal).

UC Rusal Investment Management LLC and Fonmi LLC tried to litigate decisions made at 2010 AGM on 28.06.2010 including the decision on the election of the Company’s Board of Directors.

In February 2011 Arbitration Court of the Krasnoyarsk Territory fully dismissed claims made by UC Rusal Investment Management LLC and Fonmi LLC. In May 2011 Third Arbitration Appeal Court confirmed legality and relevancy of this judicial act and rejected UC RUSAL’s Investment Management appeal.

It is noteworthy that the legality of the decisions made at the aforementioned AGM of MMC Norilsk Nickel was also confirmed by the State Prosecution and the Federal Financial Markets Service.

Thus, UC Rusal Investment Management LLC’s attempt to challenge the results of the Company’s AGM held on 28.06.2010 fell short once again.
